Terms and Conditions

General

Vinophoria, S.L. complies with legal, financial and insurance requirements under Spanish law and travel agency regulations under the license number CICMA 2076/m.

Deposit and Payment

Vinophoria, S.L. will provide the client with a written tour proposal, tour price quotation and Booking Contract which must be signed by the client and returned to us. We require a 30% deposit of the tour price, per person, to confirm a reservation. Upon paying the deposit, the client must return the signed Booking Contract.

The remaining balance of the total tour price must be paid no later than 45 days in advance of the departure date. If the departure date is less than 45 days away at the time of booking, payment must be made in full.
For one day excursions, the remaining balance must be paid at least 15 days in advance. If the departure date is less than 15 days away at the time of booking, payment must be made in full.

All payments must be made in Euros, and may be made to Vinophoria, S.L. by bank transfer or by the following credit cards: VISA, Mastercard or American Express. Payments by credit cards are subject to a service fee of 1.7% of the amount charged.

Credit card details can be accepted over the phone, or by fax, but not by email. We also require that you sign and return a Credit Card Authorization form which authorizes Vinophoria, S.L. to charge the agreed amount to your credit card.

If Vinophoria, S.L. does not receive payment in full by the required date as specified above, the reservation shall be cancelled and the deposit forfeited.

Cancellations and Refunds

Cancellations must be made in writing (letter, email or fax) by the person who made the booking and received by Vinophoria, S.L. Cancellations shall be effective on the next business day after receipt of written notice. For cancellations made more than 30 days in advance of the tour departure date, Vinophoria, S.L. will refund the total amount paid by the client less a 100 Euro administration fee per person plus any applicable bank charges. No refunds shall be made for cancellations made less than 30 days in advance of the tour departure date.

For one day excursions, the client will receive a full refund for cancellations that are made 7 business days prior to the excursion date, less a 100 Euro adminstration fee per person plus any applicable bank charges. No refund shall be made for cancellations made less than 7 business days in advance of the excursion date.

Some tours or corporate events may be subject to a different cancellation policy which shall be provided to the client in writing prior to contracting services. No exceptions are made to any tour cancellation policy.

We strongly recommend that you purchase trip interruption/cancellation insurance to prevent financial loss in case of a personal emergency, illness, accident or any other circumstance causing you to cancel your trip and subsequently lose your deposit, trip payment, and other travel costs. Vinophoria S.L. is not responsible nor liable for any loses or costs incurred by the client due to cancelling a trip booked with us, such as airline tickets or any other expenses for travel arrangements made by the client.

No refunds shall be made if a client: fails to show up for a tour departure; arrives late or leaves a tour early; or voluntarily chooses not to participate in any activity or service contracted in the tour. No exceptions shall be made to this policy.

Should a client wish to alter a booking (i.e. change dates, accommodations or activities arranged on a custom basis), Vinophoria, S.L. will make reasonable efforts to comply with such requests; however, the client will be obliged to pay for any additional expenses resulting from such changes (i.e. cancellation fees payable to hotels and/or other suppliers). In addition, we may charge, upon our sole discretion, an amendment fee of up to a maximum of 100 Euros per person to cover administration costs incurred.
If a client decides to change his/her wine tour in any way once it has commenced, we accept no liability for any loss, damage or additional expenses arising therefrom; and we cannot guarantee a refund of any costs paid by the client.

Participation in the tour

Tour participants must be 18 years of age. Minors must be accompanied by a parent or guardian who will assume full responsibility for his/her conduct and safety. There is no maximum age limit; however, tour members must be reasonably fit and mobile, and in good physical and mental health.

In addition, each tour participant is individually responsible for: arriving at the tour departure point on time; preparing for the wine tour by reading all pre-trip documentation provided by Vinophoria, S.L.; and abiding by the laws and customs of Spain during tour.

Itineraries

Vinophoria, S.L. reserves the right to modify the wineries visited, hotels, and/or restaurants specified in the itinerary subject to supplier availability at the time of booking. Should it be necessary to alter an itinerary, a supplier of equal value and quality shall be chosen. The client shall be notified in writing of any changes made to an itinerary.

Tour Prices and Additional Expenses

All prices quoted, inlcuding those shown in our brochures or on our website, are inclusive of our handling fees and IVA (value added tax) and, where published, are correct at the time of publication. Final tour prices will depend on the number of participants in the tour, accommodation and restaurant choices, wineries visited, and activities included within the tour or arranged on a custom basis, and will be quoted to the client at the time of booking.

Any expenses incurred by the client during a wine tour that are not explicitly listed as included in the tour price in the “this tour includes” section of the itinerary and Booking Contract must be paid by the client.

Lunches and dinners specified in the itinerary are pre-arranged menus of 3 – 6 courses and include mineral water, and coffee/tea. For meals in which wine is included in the menu, wine is calculated at one bottle per two people. Charges for additional bottles of wine, other beverages, or á la carte items ordered by the client during a pre-arranged meal shall be paid by the client.

Insurance

When a client books a tour, Vinophoria, S.L. will acquire limited travel assistance insurance on behalf of the client. Travel assistance does not include unlimited medical insurance nor does it cover any property damage, loss or theft. We require that each tour member obtain appropriate travel and medical insurance coverage which extends to Spain before joining a wine tour.

Vinophoria, S.L. will not be liable for any expenses incurred because of a client’s failure to obtain appropriate insurance.

Force Majeure

Vinophoria, S.L. is responsible solely for coordinating tour-related services and goods that are specifically included within an agreed upon tour itinerary. We regret that Vinophoria, S.L cannot accept liability or pay any compensation for loss or damage of personal affects, or any injury or loss during a trip due to ‘force majeure’, or where the performance of contractual obligation is prevented or affected by ‘force majeure.’ In these booking conditions, ‘force majeure’ means any event which we or the suppliers of any of our services could not, even with all due care, foresee or avoid. Such events may include war or threat of war, civil strife, terrorist activity, industrial dispute, natural or man-made disater, fire, adverse weather conditions, and all similar events outside our or the relevant suppliers’ control.

Liability

Under no circumstances does Vinophoria S.L. accept any responsibility or liability for any loss, theft, or damage of personal effects or for any injury or loss during the trip, ‘force majeure’ notwithstanding, due to other acts or incidents beyond its ability to control, such as thefts and dangers incident to land travel, conduct of tour participants, actions of transport providers, activity organizers, or any other service suppliers.

Law & Jurisdiction

These terms and conditions are governed by Spanish law and all all matters arising therefrom shall be subject to the exclusive jurisdiction of courts located in Madrid, Spain.
